Nancy Derwin-Weiss

Recognized in 2009 by The Hollywood Reporter in its “Power 100” list, which recognizes the 100 most influential entertainment lawyers in America, Nancy works with a diverse range of industries, including motion picture, television, fashion, consumer products, food, social networking, and theatre companies. As the way in which companies compete to reach their audience continues to evolve, Nancy’s experience in new media allows her clients to push the envelope in their marketing and advertising initiatives in a field where every campaign competes to be more innovative and cutting-edge than the one before. With innovation, comes challenges, and Nancy has built a knowledge base around the legal issues inherent in new and evolving media campaigns. Nancy works closely with her clients to bring their promotional campaigns from concept to execution, both online and offline, managing the legal aspects of each transaction as they arise. She advises her clients on sweepstakes, contests, user generated content programs, social networking, viral marketing, twitter campaigns, iphone applications and other wireless marketing initiatives. Nancy’s experience is invaluable to her clients. As the General Counsel of Summit Entertainment (for which Nancy provides marketing and advertising counsel on their films, including "The Twilight Saga" franchise) noted: “Nancy’s unparalleled expertise in handling innovative marketing campaigns supported Summit in achieving its greatest box office success since its formation -- success that would not have been attained without the key marketing strategies implemented and Nancy’s critical understanding of the legal issues surrounding them.”

Nancy Derwin-Weiss has practiced new media and Internet law since the early 1990s, first in private practice and then at Paramount Pictures Corporation from 2000-2007. Overseeing legal and business affairs for Paramount Digital Entertainment, Inc., Nancy was charged with exploiting content on new media platforms. She was also the first Vice President of Legal for the Interactive Marketing division, handling online marketing for Paramount Pictures, DreamWorks Pictures and Animation. She is a founding member of "Women in New Technologies" and a member of the USC Entertainment Law Institute Planning Committee.


Representative Experience:

  • Develops and implements privacy and data security compliance programs.
  • Audits and clears dozens of motion picture and television web sites for legal compliance.
  • Works closely with clients throughout development process to ensure that web sites are compliant with FTC, COPPA, Guild, MPAA and federal and state law and regulations. 
  • Develops web site marketing and clearance guidelines. 
  • Negotiates and drafts a wide variety of contracts, including content distribution and license agreements, co-promotion and marketing agreements, web site development agreements, video production agreements, talent agreements and insertion orders. 
  • Prepares sweepstakes rules and conducts detailed reviews of co-promotions, sweepstakes and contest materials, including marketing materials. 
  • Represents television and motion picture writers and producers in contractual matters.
