The insurance industry and government continue to decrease reimbursement rates for health care services provided to patients, placing tremendous fiscal pressure on health care providers to control the use of services without compromising the quality of patient care. Simultaneously, health care providers face increased litigation exposure and regulatory scrutiny by state and federal governmental agencies on a myriad of issues that affect their ability to operate.

  • Successfully represented a Fortune 200 pharmaceutical company as national coordinating counsel in its defense of product liability litigation filed in a dozen states involving a leading anti-inflammatory medication
  • Successfully represented an accrediting agency for graduate medical education program in a purported national class action relating to the Match program for resident physician positions, and in other lawsuits in a dozen states and in Puerto Rico
  • Successfully represented national medical physician association in antitrust actions brought by chiropractors
  • Successfully argued ADA appeal in the Seventh Circuit for a national physician specialty certification board
  • Successfully represented healthcare provider in one of the first reported appellate decisions to construe the Medicare/Medicaid anti-kickback statute
  • Successfully recovered hundreds of thousands of dollars worth of fees owed to various physician group practices and out-patient surgical centers by third-party payors
  • Successfully represented physician group practice before the Illinois Supreme Court arguing that an uncertified professional corporation may enforce its right to direct payment from a major health insurance company
  • Counseled numerous hospitals, health systems, long-term care facilities, ambulatory surgical treatment centers, and others on CON issues in acquiring, constructing, and financing health care facilities and major medical equipment
